In addition to the Sony Ericsson Legal Notice including User Terms and Privacy Notice, you hereby accept and agree that the following rules apply without limitation to the PhotoMatch game and your use of this web-site:

1. This Game and the web-site are hosted and arranged by Sony Ericsson Mobile Communications AB, a company registered in Sweden with its main office at Nya Vattentornet, 221 88 in Lund, Sweden ("Sony Ericsson").
2. Before entering the Game it is important that you have read and accepted Sony Ericsson's Legal Notice including User Terms and Privacy Notice.
3. This Game is open for all participants. Participants must be at least 18 years old. Participants can not be legal entities.
4. No purchase or fee is required for participation in the Game but you must complete the registration form available on www.sonyericsson.com/K700 to participate. Only one registration form may be submitted per participant
5. The maximum image file size that can validly be entered into the Game is 120k. Files exceeding the maximum size will not be accepted. Any inappropriate images (as deemed by the judges) will not be accepted. You will however, be given another chance to upload if this is the case.
6. Mandatory fields will require you to state a username and password, your age, e-mail address and resident country in the registration form. In the event complete and correct information is not provided, the form will be considered incomplete and therefore invalid. Invalid forms will not be accepted as valid entries in the Game.
7. Information regarding personal data provided in the form will be collected, stored and processed in a database for the purposes of managing the Game. Such information will not be used for any other purposes than as stated in these rules or as separately accepted by you. The Sony Ericsson Privacy Notice applies to any processing of data performed in connection herewith displayed at www.sonyericsson.com/legal. You hereby agree that we may use your personal data to confirm by e-mail your successful registration and upload of image. If you have separately agreed and accepted to receive promotional offers and news updates from this web-site, we may use your personal data for such direct marketing purposes.
8. Under no circumstances whatsoever will you be refunded or compensated in cash or in kind for any use whatsoever of your image by Sony Ericsson, its subsidiaries or branch offices.

As a participant you hereby guarantee that you own all intellectual property or other rights necessary for distribution and public display of any submitted text, image or message, regardless of the format that it is provided in, and you hereby grant Sony Ericsson, its subsidiaries and branch offices the perpetual right to exclusively, royalty-free and without limitation freely use, modify, edit, copy, reproduce, distribute, translate, create derivate works from, alter and publicly display or publish such text, picture or message, for whatever purposes, in any form or medium, either on this web-site or elsewhere, whether promotional or in other activities or events arranged by Sony Ericsson or any of the above stated parties, whether locally or world-wide.
11. You hereby agree and accept that when Sony Ericsson, its subsidiaries or branch offices use any such content, including images, in accordance with the rights granted herein, and if applicable law so requires to protect your absolute and unrestricted intellectual property rights, we will to the extent technically possible, quote your user name as stated in the registration form, to designate you as originator of the content, including images, and that neither Sony Ericsson, nor its subsidiaries, branch offices or partners will incur any liability whatsoever as a result hereof.
12. Neither Sony Ericsson, its subsidiaries, branch offices nor partners accept any liability whatsoever for any text, picture or message, regardless of the format that it is provided in, that is offensive, discriminatory, confidential, in violation of applicable legislation or infringes any third party or other protected rights under applicable laws or treaties.
13. You agree to indemnify and hold Sony Ericsson, its subsidiaries, branch offices and partners harmless from any claim or demand, including reasonable attorney's fees, made by any third party due to or arising out of any content, image, text or other message you submit, post, transmit or make available on the web-site in any form whatsoever.
14. In addition, you are solely responsible and liable for all of your activities including upload of any content, text, image or other message on the Sony Ericsson web-site including this campaign web-site and participation in the Game. Listed below are some, but not all, violations that may result in immediate termination of your access to the web-site:
    1. Publish, upload, post, e-mail or transmit any content that is illegal, obscene, or libelous;
    2. Harass, threaten, embarrass, or interfere with another user in any unwanted way;
    3. Upload, post, transmit or facilitate distribution of content that is libelous; harmful, threatening, harassing, abusive, racially or ethnically offensive, vulgar, sexual, explicit, obscene, defamatory, or objectionable;

    5. Impersonate any person or legal entity. You are not allowed to impersonate another user or any other individual;

    7. Publish any advertising or promotional material;
    8. Upload a virus or other harmful component that may interrupt, destroy or limit the functionality of any computer software, hardware or telecommunications equipment;
    9. Interrupt or attempt to interrupt the web-site;
    10. Collect or store personal data about other users;
    Sony Ericsson reserves the unilateral and unlimited right to immediately and without prior notification remove, delete and destroy content at any time, including but not limited to, any content that violates these standards and to prevent your future use of this or any other Sony Ericsson site or any site belonging to its subsidiaries, branch offices or partners.

You hereby accept that Sony Ericsson may establish general practices and limits concerning use of this web-site and participation in the game, including without limitation the maximum number of days that uploaded content may be available or retained on the web-site, the maximum size of any such uploaded content and that Sony Ericsson will not under any circumstances whatsoever be liable for the deletion or failure to store any messages, content or other communications maintained or transmitted by the web-site.

Sony Ericsson reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently this web-site, the game or any part thereof, with or without prior notice to you. You hereby agree that Sony Ericsson shall not be liable under any circumstance whatsoever to you or any third party for such modification, suspension or discontinuance of this web-site or any Game.
17. In addition to what has been stated above, you agree that Sony Ericsson may at any time and in its sole discretion, terminate your password, use of this web-site and remove and discard any uploaded or other Content for any reason. You agree that Sony Ericsson shall have no liability whatsoever to you or any third party for such termination.
18. Any controversy arising out of your use or attempted use of this web-site or participation or attempted participation in any game shall be fully and finally resolved by the courts of Sweden. Swedish law shall be applicable without regard to any conflict of law principles.
19. Voting: Any user can vote on any number of images in one single day. However, no single image can be voted for more than once in a day.
20. Matching: Only registered users can upload matching images. Only camera phone images will be accepted.
21. Starting your own game: Users will need to make a match in each of the four categories before they can start a game with an original image of their own. Users can also upload a matching image to their own original image.
22. Top 10 Photo Matches: Only the top 10 images with the highest number of votes will be shown on the Top 10 Photo Matches page.
23. Image Moderation/ Consideration: All images that have been uploaded will be considered for their suitability in the following criteria, as applicable:
    - A real match
    - Image quality
    - Right for the category selected
